EU Digital Services Act

This page provides information in accordance with the EU Digital Services Act (Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC) (the DSA). DJI adheres to the DSA and is committed to promoting transparency and data security for all users and recognizes the importance of regulating online platforms and services.

Designated Point of Contact (Article 11 & 12)

Pursuant to Articles 11 and 12 of the DSA, DJI has designated the support@dji.com as DJI’s point of contact for communications with Member State authorities, the European Commission and the European Board for Digital Services. Such communications should be in English or German. For users of DJI’s services, DJI has designated support@dji.com as DJI’s point of contact.

DSA Annual Transparency Reports (Article 15 & 24)

Pursuant to Article 15 and 24 of the DSA and DJI’s commitment to transparency, DJI publishes transparency reports providing information on DJI’s operations under the DSA.

Reporting Inappropriate Content: Notice and Action Mechanisms (Article 16)

Pursuant to Article 16 of the DSA, any individual or entity can report illegal content on DJI’s services or breaches of our Terms of Use to us by filing a content report notice.

Any report emailed to us should be accompanied with the following information:

  • An explanation of the reasons why you think the information is illegal content;
  • The location/URL of such content;
  • Your name and email address; and
  • A statement confirming that you believe the information in the report is accurate and complete.

We promptly review reports that are submitted to us, and will take appropriate action upon verified reports. If we determine that you provided content that is illegal or that you have breached our Terms of Use, for example by posting content of a type that we prohibit, we may restrict or remove that content and suspend or permanently disable your access to our services.

Internal Complaint-handling System and Out-of-Court Dispute Settlement (Article 20 & 21)

Pursuant to Article 20 of the DSA, individuals or entities making use of our online platforms may dispute the decisions that we take about notices, content and user accounts. If you believe that we have mistakenly taken action against your account or reported content, or have not acted appropriately on a notice you have submitted, you can appeal our decision within six months of receiving the contested decision. The appeal is free of charge and you may contact us by email at support@dji.com. Please include a reason for your appeal and attach any supporting documents (if available).

If your complaint has not been resolved through our internal complaint-handling systems, you may contact a certified out-of-court dispute settlement body to help resolve any dispute with us relating to our actions on your account or reported content, including if you disagree with the outcome of an appeal. The European Commission publishes a list of those bodies at digital-strategy.ec.europa.eu/en/policies/dsa-out-court-dispute-settlement. Decisions by out-of-court dispute settlement bodies are not binding on you or on DJI, however we will engage in these settlements in good faith.

Measures and Protection Against Misuse (Article 23)

In accordance with Article 23 of the DSA, and in order to maintain a safe environment for all our users, we may, after providing a prior warning, temporarily suspend our services for a reasonable period of time for those recipients who repeatedly share manifestly illegal content.

Furthermore, to protect the integrity of our processes, we will, after issuing a prior warning, suspend the processing of notices and complaints for a reasonable period of time where an individual or entity repeatedly submits notices or complaints that are manifestly unfounded.

European Monthly Active Recipients Information (Article 24(2))

DJI regularly monitors the number of users on its online platforms in the EU, with evaluations conducted at least every six months. Based on the last evaluation in the preceding 6 months period, the average number of monthly active recipients of DJI online platforms in the EU was well below the threshold of 45 million. This calculation has been conducted based on relevant guidance published by the European Commission. DJI will continue to monitor the number of average monthly active recipients on its online platforms in the EU and will publish updated information in accordance with Article 24(2) of the DSA.
